8 Discipline
If the state bar imposes discipline, it can range from private reprimand to disbarment. The state bar can:
- issue a private reprimand (usually a letter sent to the lawyer)
- issue a public reprimand (usually published on the state bar’s website and attorney newsletter)
- suspend the lawyer (the lawyer cannot practice law for a specific time)
- disbar the lawyer (the lawyer loses his or her license to practice law)
Note that a private reprimand is the lowest form of discipline under the rules, while disbarment is the most serious.
Reciprocal Discipline
Reciprocal discipline means that a lawyer who is subject to discipline in one state may also be disciplined for the same misconduct in any other state where the lawyer is licensed to practice law. Why? To protect the public in other jurisdictions. Permitting a lawyer who is suspended or disciplined in another state exposes the public to harm, undermines the integrity of the legal profession, and erodes public confidence in the legal profession.
